On July 1, 2005 the provisions of the Building Code Act, 1992 and the Building Code that mandate the use of a common building permit application form (“Application For a Permit to Construct or Demolish”), came into force.
The common application form is submitted to your local municipality / principal authority with your complete building permit application, and not to the Building and Development Branch in the Ministry of Municipal Affairs and Housing.
The common application form streamlines the building regulatory process throughout Ontario by providing certainty to municipalities, designers and builders as to the information required at the time of the building permit application.
The Minister of Municipal Affairs and Housing originally approved the common application in July 2003. As a result of input from stakeholders, and regulatory amendments since July 2003, the form was updated to include the following:
- A new section to collect builder information.
- Changes to reflect the extension of the implementation period for certain requirements to January 1, 2006, including the qualification and registration requirements for designers.
- Changes to indicate that licensed architects do not need to fill out the designer information section as a result of the establishment of a parallel qualification and registration system by the Ontario Association of Architects; and
- An update to reference the Tarion Warranty Corporation (successor to the Ontario New Home Warranty Program).
In 2008 this form was further updated to refer to the current edition of the Building Code (Ontario Regulation 350/06, as amended). The “Declaration of Designer”, in section D, has also been modified.
