On August 20, 2004, O.Reg. 245/04 was filed, amending Part 2 of the Building Code.
This amendment repeals provisions that would have allowed builders to appoint their own private inspection agencies. The amendment is intended to protect public safety by removing the potential for conflicts of interest in building plan review and construction inspections.
The August 20, 2004 amendment removes regulatory provisions, originally set to take effect on July 1, 2005, that would have enabled builders to appoint registered code agencies (RCAs).
Municipalities may still appoint RCAs to meet their responsibilities to enforce the Building Code.
The changes are set out in O.Reg. 245/04
